Service

By accessing or using ClusterATL (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and ClusterATL LLC, a Georgia limited liability company ("ClusterATL," "we," "our," or "us").

We reserve the right to terminate accounts of users who misrepresent their age or eligibility.

Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information up to date.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

One Account Per Person

You may not create multiple accounts. We reserve the right to merge or terminate duplicate accounts at our discretion.

Permitted Use

You may use ClusterATL for personal, non-commercial purposes in accordance with these Terms.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Harass, threaten, intimidate, or harm other users
• Post or transmit content that is defamatory, obscene, hateful, or discriminatory
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated tools, bots, scripts, or scrapers to access or interact with the Service
• Manipulate, exploit, or abuse any platform feature including the Cred points system, games, or sweepstakes
• Interfere with or disrupt the integrity or performance of the Service
• Facilitate or assist any third party in doing any of the above

Platform Content

All content submitted, posted, uploaded, or otherwise made available on ClusterATL — including but not limited to Block Talk voice notes, neighborhood posts, comments, game responses, and profile information — becomes the property of ClusterATL LLC upon submission.

By submitting content, you irrevocably assign to ClusterATL LLC all rights, title, and interest in that content, including all intellectual property rights, worldwide and in perpetuity.

ClusterATL's License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

Our Content

All other content on the Service — including the ClusterATL name, logo, design, software, and platform features — is owned by ClusterATL LLC and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent.

Nature of Cred

Cred points are a platform reputation currency with no monetary value. They cannot be transferred, sold, exchanged for cash, or redeemed outside of ClusterATL's designated platform features.

Earning and Use

Cred is earned through participation in platform activities as described in-app. ClusterATL reserves the right to modify how Cred is earned, spent, or valued at any time without prior notice.

No Guaranteed Value

ClusterATL makes no guarantee regarding the availability, accumulation, or continued existence of Cred points. Points may be adjusted, reduced, or forfeited as a result of account violations, inactivity, or platform changes.

Hard Floor

Accounts in good standing will not fall below a Cred floor of 25 points through passive decay. Violations of these Terms may result in further point reductions regardless of this floor.

Separate Rules Apply

Sweepstakes, giveaways, contests, and promotional games (including Pull Up & Play) are governed by their own Official Rules, which are incorporated by reference into these Terms. In the event of a conflict, the Official Rules for a specific promotion control.

Eligibility

Participation in sweepstakes is open to legal residents of the United States who are 18 years of age or older at the time of entry, subject to any additional restrictions stated in the applicable Official Rules.

No Purchase Necessary

No purchase or payment is required to enter or win any ClusterATL sweepstakes. A free method of alternative entry (AMOE) is always available, as described in the Official Rules.

Prize Claims

Winners are responsible for any federal, state, or local taxes on prizes. Prizes are non-transferable and may not be substituted for cash except at ClusterATL's sole discretion. ClusterATL reserves the right to substitute a prize of equal or greater value if a stated prize becomes unavailable.

Fraud and Manipulation

Any attempt to manipulate, exploit, or defraud any sweepstakes or promotion will result in immediate disqualification and may result in account termination. ClusterATL reserves the right to void entries it determines to be fraudulent.

Warnings

For first-time or minor violations of these Terms, we will generally issue a warning before taking further action. We are not obligated to provide a warning in cases involving illegal activity, severe harassment, fraud, or other serious violations.

Suspension and Termination

Following a warning, continued violations may result in temporary suspension or permanent termination of your account. We reserve the right to determine the appropriate response at our sole discretion.

Effect of Termination

Upon termination, your right to access the Service ceases immediately. Any Cred points, sweepstakes entries, or platform standing associated with your account will be forfeited. Content you submitted prior to termination remains the property of ClusterATL LLC.

Appeals

If you believe your account was suspended in error, contact us at [email protected] within 30 days of suspension. We will review appeals on a case-by-case basis and our decision is final.

As-Is Service

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

No Endorsement

ClusterATL does not endorse or guarantee the accuracy of any user-submitted content or community information.

To the fullest extent permitted by law, ClusterATL LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service — even if we have been advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless ClusterATL LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Informal Resolution

Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration

If informal resolution fails, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered under the rules of the American Arbitration Association (AAA), conducted in Atlanta, Georgia.

No Class Actions

You agree to resolve disputes with ClusterATL only on an individual basis. You waive any right to bring or participate in a class action, consolidated action, or representative proceeding.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm while arbitration is pending. Claims falling within small claims court jurisdiction may be brought there instead of arbitration.

Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you through the app or via email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

Entire Agreement

These Terms, together with our Privacy Policy and any applicable Official Rules for promotions, constitute the entire agreement between you and ClusterATL LLC regarding the Service.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Assignment

You may not assign your rights or obligations under these Terms. ClusterATL may assign its rights and obligations without restriction.
